Can Liability Improve Clinical Genomics?

The failure of health care providers to utilize genomics has been identified as one of the major roadblocks to the success of clinical genomics.  This presentation will critically evaluate whether medical malpractice liability can improve the appropriate and accurate use of genomics by providers.  In assessing this issue, the presentation will discuss the frequency of legal errors in clinical genomics, the impact of potential liability on behavior change and deterrence, the impediments to redressing those errors through litigation, the potential adverse side effects of litigation including defensive medicine and legal uncertainty, and the overall effectiveness and efficiency of litigation as a risk management strategy.
